1. Who we are
BeYouTee is operated by Sebastien Seraphin, a sole proprietor, under the name BeYouTee. BeYouTee designs and sells simple static websites to local businesses. This policy explains, in plain terms, how we collect, use, disclose, keep and destroy your personal information when you use our website beyoutee.store, our contact form, our Instagram account @beyoutee.web, email or telephone. It is published in accordance with the Act respecting the protection of personal information in the private sector (the “Act”, as amended by Law 25).
2. Person in charge of the protection of personal information
Person in charge of the protection of personal information: Sebastien Seraphin. Email: sebastienseraphin@hotmail.com. Telephone: 418-473-4765. Any question, request or complaint may be addressed to this person.
3. Information we collect
- Contact form: name, email address, telephone number (optional), your business name (optional), your industry and the website template you prefer (chosen from lists), and the content of your message.
- Instagram (@beyoutee.web): your username, the display name on your profile, the content of your messages, and any files or photos you send us.
- Email and telephone: your contact details and the content of our exchanges.
- Clients: contact details, information needed for invoicing and content provided for the website (text, logos, photos).
- Technical data: our site’s host may automatically record, in its technical logs, data such as the IP address, browser type and date of visit, for security and operational purposes, according to that host’s own privacy policy.
We collect only the information necessary for the purposes set out below. Please do not send us sensitive information (e.g., health information, identity numbers): we do not need it.
4. Why we use it (purposes)
- To answer your questions and prepare a quote for you.
- To enter into and perform a contract with you: to build, deliver and, where applicable, maintain your website.
- To invoice and meet our legal obligations.
- To ensure the security and proper operation of the site and to prevent fraud.
We do not use your information for other purposes without your consent, except where the Act allows it. We do not sell your personal information.
5. Consent and withdrawal of consent
By writing to us through the form, through Instagram or by email, you consent to our using your information for the purposes described in section 4. Any other use (for example a newsletter or featuring your site in our portfolio) is subject to separate consent, which you are free to refuse. You may withdraw your consent at any time by writing to the person in charge (section 2); however, withdrawal may prevent us from answering your request or performing a contract in progress. Our site is not intended for people under 14: we do not knowingly collect their information without the consent of the person with parental authority.
6. Who has access to your information
Within BeYouTee, Sebastien Seraphin, who operates BeYouTee, has access to your information, and only when necessary for his duties.
We use the following providers, which may use your information only to provide their services to us:
- Website hosting and contact form: Netlify, Inc. The site’s contact form is processed by the Netlify Forms service.
- Email: Microsoft (Outlook.com / Hotmail), for the address sebastienseraphin@hotmail.com.
- Site fonts: Google Fonts (Google LLC). Your browser loads these fonts from Google’s servers, which therefore receive your IP address.
- Instagram: Meta Platforms. When you write to us on Instagram, Meta also collects and processes your messages under its own terms and privacy policy, over which BeYouTee has no control. We encourage you to read them.
We may also disclose information without your consent where the Act permits or requires it (for example to our lawyer, or to an authority that has the power to compel it).
7. Disclosure outside Quebec
Some of our providers (notably the host, the email provider and Meta) may keep or process your information outside Quebec, for example in the United States. Before disclosing or entrusting information outside Quebec, we carry out a privacy impact assessment that takes into account the sensitivity of the information, the purpose, the protection measures (including contractual ones) and the applicable legal regime, and we proceed only if the information would receive adequate protection, under a written agreement (section 17 of the Act).
8. Retention period
- Inquiries with no follow-up (form, email, Instagram): we keep them only as long as needed for the purposes for which they were collected, then we destroy them.
- Clients: for the duration of the contract, then for the period required by applicable laws.
- Instagram messages: deleted on our side when no longer needed; Meta may keep them under its own rules.
At the end of these periods, or when the purposes have been fulfilled, we destroy or anonymize the information in accordance with the Act.
9. Security
We take reasonable security measures given the sensitivity of the information: limited access and an encrypted connection (HTTPS) on our site. Since no method of transmission over the Internet is completely secure, we ask that you not send us sensitive information.
10. Cookies and analytics tools
Our site uses no audience analytics tool, no advertising pixel and no technology intended to identify you, locate you or build a profile of you, and does not itself set any tracking cookies. To display properly, it loads its fonts from Google’s servers (Google Fonts), which then receive your IP address (see section 6).
Links to Instagram or other sites take you to third-party services that have their own policies.
11. Your rights
- Access: find out whether we hold information about you and obtain a copy, including, on request, in a structured and commonly used technological format.
- Rectification: have inaccurate, incomplete or equivocal information corrected, or have information deleted if its collection, disclosure or retention is not authorized by law.
- Withdrawal of consent: withdraw, at any time, your consent to the use or disclosure of your information.
- Cessation of dissemination and de-indexing: ask us to stop disseminating information about you, or to have a hyperlink attached to your name de-indexed, under the conditions set out in the Act.
- Information: find out what information we hold, who has access to it, how long we keep it and how to reach the person in charge.
To exercise your rights, write to the person in charge (section 2). We may verify your identity. We will reply in writing no later than 30 days after receiving the request. Access is free of charge; reasonable fees for transcription, reproduction or transmission may be charged, after we have told you the approximate amount.
12. Privacy incidents
If we have reason to believe that a privacy incident (unauthorized access, use or disclosure, or loss) affects your information, we take reasonable measures to reduce the risk of harm and to prevent a recurrence. If the incident presents a risk of serious harm, we promptly notify the Commission d’accès à l’information (Quebec’s access to information commission) and the persons concerned. We record privacy incidents in a register, as the Act requires.
13. Questions and complaints
For any question or complaint about the protection of your information, write first to the person in charge (section 2). We will acknowledge receipt of your complaint and reply in writing within a reasonable time. If you are not satisfied, you may contact the Commission d’accès à l’information du Québec (www.cai.gouv.qc.ca), in particular to request an examination of a disagreement (generally within 30 days of a refusal or of no response) or to file a complaint.
14. Changes to this policy
We may change this policy. Any change will be announced by a notice published on our site, with the update date.
